1) About these Terms

These Terms and Conditions (“Terms”) are issued by Checkify Technologies Ltd (“Checkify”, “we”, “us”, or “our”), the company operating the Checkify platform.

They govern your access to and use of Checkify websites, mobile applications, APIs, SDKs, plugins, dashboards, verification services and related products or services made available by Checkify from time to time (together, the “Services”). Our primary website is checkify.me.

In these Terms:

• “User” means an individual who uses the Checkify app or completes, responds to, or interacts with a verification request.
• “Business” or “Relying Party” means a business, website owner, developer, operator or organisation that requests, receives or relies on Checkify proofs or verification results.
• “Verification Request” means a request created through Checkify asking a User to provide a proof, attribute check or other verification outcome.
• “Proof” or “Verification Result” means the limited outcome, signal or evidence returned by Checkify for a Verification Request — for example whether a configured check was approved, an age threshold was met, a human-verification check was completed, or another configured result. Different Proofs may involve different assurance levels and types of assertion. A human-verification Proof is not the same as identity verification, and an age-threshold Proof is not a full identity verification, unless those checks were separately configured and disclosed.
• “Checkify Pass” (or “Pass”) means a Business-configured proof request associated with a site or integration that defines what a User is asked to prove and can be presented through supported channels (such as a website embed, plugin, API/SDK flow or QR code).

These definitions are intended to be practical and readable. They do not replace meanings required by applicable law.

2) Acceptance and eligibility

By creating an account, using the Checkify app, completing verification, scanning or responding to a Checkify request, integrating Checkify, using business dashboards or APIs, or otherwise using the Services, you agree to these Terms.

If you do not agree, you must not use the Services.

If you accept these Terms on behalf of a company or other organisation, you confirm that you have authority to bind that organisation. In that case, “you” includes the organisation.

You must be old enough under applicable law to accept these Terms and use the Services. Where a Service is intended for a particular age group or use case, additional eligibility rules may apply in the product flow.

3) What Checkify provides

Checkify is a privacy-first verification platform. It allows people to establish or provide limited evidence about attributes or conditions, which may include age thresholds, human verification, identity assurance, business verification, eligibility and other configured proofs.

Checkify’s design objective is to provide answers and proofs rather than unnecessary documents or raw personal information where possible. Businesses typically receive a limited Verification Result for a configured request.

Availability of particular proof types, flows and integrations varies by product, country, configuration and commercial plan. Checkify does not guarantee that every Service operates entirely on-device, or that every proof type is available for every Business.

4) Verification sources and methods

Depending on the Service, Verification Requests may use different methods and data sources. These may include device signals; identity documents; NFC-enabled documents; camera, selfie or liveness checks; third-party credential or wallet providers; trusted data issuers; business-provided information; external verification services; and other approved sources made available by Checkify from time to time.

Which methods are available depends on the product, country, integration and configuration. Checkify does not promise that every source or method will be available, accurate for every use case, or suitable for every legal requirement.

5) Verification results are evidence, not guarantees

A Checkify Proof or Verification Result reflects the evidence, configuration and verification methods available at the time of the request. It is a verification signal for that request — not an absolute guarantee of identity, future eligibility, honesty, legality, creditworthiness, safety, suitability or regulatory compliance.

Businesses remain responsible for deciding what level and type of verification is appropriate for their use case, risk appetite and legal obligations. Where Checkify provides a Proof, it does not make the Business’s final legal, commercial, access or eligibility decision unless a separate written agreement expressly says otherwise.

Do not treat a Checkify result as certifying a person for all purposes. For example, an age-threshold Proof such as “Over 18” must not be presented as proving a person’s full identity unless identity was separately verified and disclosed under the relevant request.

A Business’s initiation of or payment for a Verification Request does not give that Business ownership of the User’s identity, underlying identity information, device-held credentials, reusable proofs, wallet contents or credentials obtained from other issuers. The Business receives only the Proof, Verification Result or other information made available for that request.

Where supported by the relevant Service, a User may be able to reuse an existing credential or previously established evidence to respond to another Verification Request without repeating the original collection process. Reuse is not guaranteed for every Proof or feature. Each subsequent use may create a new Verification Request and result. A Business does not automatically gain access to the User’s previous interactions with other Businesses. Reuse remains subject to validity, expiry, configuration, User action or permission and the applicable Service rules.

A Proof may include or depend on information such as when it was established or verified, its assurance level, source, expiry, status or, where supported, revocation/status information. Different Businesses may require different levels of assurance or recency. A previously established Proof should not be assumed to remain suitable indefinitely. Businesses remain responsible for deciding whether a particular Proof is sufficiently recent and appropriate for their use case.

6) Business and relying-party responsibilities

If you use Checkify as a Business or Relying Party, you are responsible for:

• Selecting verification requirements — including the type of Proof and any required assurance or recency — that are appropriate and proportionate for your use case and jurisdiction.
• Complying with laws and regulations that apply to your activities, including age-restricted sales, consumer, privacy and anti-discrimination rules where relevant.
• Configuring Checkify Passes, Verification Requests, integrations, websites and workflows correctly and securely.
• Using Verification Results only for legitimate purposes disclosed to Users where required.
• Avoiding requests for unnecessary information when a limited proof would meet your need.
• Providing any notices and obtaining any consents required for your use of Checkify.
• Protecting information received through Checkify and applying appropriate security, access and retention controls consistent with applicable law and the purpose for which it was obtained. Receipt of a Verification Result is not permission to retain it indefinitely where law or purpose no longer supports retention.
• Maintaining suitable fallback procedures if Checkify is unavailable, delayed or returns an unexpected result.
• Making your own final decisions about transactions, access, eligibility and compliance.
• Not misrepresenting what Checkify has verified. You must not present a result as proving something beyond the actual Proof returned.

Using Checkify does not automatically make your Business compliant with every law that applies to your activities. Checkify can provide verification technology and evidence designed for age-assurance and other verification workflows, but you remain responsible for selecting the required assurance level, implementing the integration correctly, enforcing the result, and satisfying the law applicable to your specific activity and jurisdiction.

Initiating or paying for a Verification Request does not transfer ownership of the User’s identity information, device-held credentials, reusable proofs, wallet contents or third-party credentials to your Business.

7) User responsibilities

If you are a User, you agree that you will:

• Provide accurate information where required for a verification or account function.
• Use the Services only for lawful purposes.
• Protect your account, device, PIN, biometric access and credentials.
• Not impersonate another person or use another person’s documents, credentials, device or account without lawful authority.
• Not bypass, manipulate or interfere with verification, device or security signals.
• Not submit fraudulent Verification Requests or attempt to obtain false Proofs.
• Not attack, disrupt or reverse engineer the Services except to the extent such activity is expressly permitted by applicable law (including lawful security research where that law prevents Checkify from prohibiting it).
• Not knowingly alter a Proof, falsify its source, alter its assurance level, expiry or status, replay a Proof outside its intended context where that is restricted, or represent one type of Proof as another.

8) Privacy and data processing

How Checkify handles personal information is explained in our Privacy Politica. That policy forms part of how the Services operate and should be read with these Terms.

Checkify is designed around privacy and data minimisation. Depending on the Service, verification may occur on-device or through privacy-minimising processing. Where supported by the relevant feature, sensitive verification information may be processed or retained on the User’s device, allowing Businesses to receive a limited Proof or Verification Result rather than unnecessary underlying identity information.

Checkify may still process information required to operate the Services. This can include account information; request and reference identifiers; verification outcomes; security information; device information; audit events; operational logs; fraud-prevention signals; information required by a particular verification feature; and information required for legal compliance or support.

These Terms do not mean that Checkify never processes or stores information. Operational, security, audit and verification metadata may be processed or retained where necessary, as described in the Privacy Policy.

The respective data-protection roles of Checkify and a Business may depend on the Service and processing involved and may be further described in the Privacy Policy, a Data Processing Agreement or an applicable commercial agreement. These Terms do not state that Checkify is always a controller, processor or joint controller for every activity.

9) Security

Checkify uses reasonable technical and organisational measures designed to protect the Services and information processed through them, including encryption in transit and appropriate access, integrity, monitoring and security controls. Further implementation detail may appear on the Security page.

References to encryption in transit do not mean that every Checkify data flow is end-to-end encrypted in all circumstances.

No system, transmission method or storage mechanism can be guaranteed to be completely secure. You must tell us promptly if you believe your account, device, key, verification, integration or related credentials have been compromised.

10) Third-party services, wallets and data issuers

Some Services may depend on third parties, including identity or document services, data issuers, credential providers, wallets (including external wallets), government or education credentials, business credentials, trusted data providers, payment providers, hosting or infrastructure providers, platform integrations and other credential ecosystems made available by Checkify from time to time.

Those third parties may have their own terms and privacy policies. Checkify does not control every third-party service and does not guarantee the availability, accuracy or continued operation of independent third-party services beyond what Checkify can reasonably control.

Details of certain service providers and subprocessors may appear in the Privacy Policy or related documentation rather than in these Terms.

Where a Proof relies on information or a credential issued by a third party, Checkify may verify, validate, process or communicate that credential or a resulting Proof without being the original issuer of the underlying information. The issuer may remain responsible for the original assertion. Checkify remains responsible for Checkify’s own verification, processing and presentation of a Proof through the Services. Checkify does not automatically adopt every third-party assertion as its own statement of fact, and this does not excuse Checkify from responsibility for its own errors in operating the Services.

11) Integrations, plugins, APIs and SDKs

Checkify may make integrations, plugins, APIs and SDKs available from time to time, including for common website and commerce platforms and for custom applications. Not every integration is generally available in every market or plan.

Businesses and developers are responsible for correct installation and configuration; securing API credentials and secrets; their own code, websites and platforms; and keeping supported versions updated.

Checkify may change, limit or discontinue integration functionality where required by platform rules, API changes, security needs or product decisions. You should review release notes and documentation for supported versions.

12) Beta and experimental features

Checkify may designate certain functionality as beta, preview, experimental, pilot or early access. Designated beta or preview features may contain errors, may change materially, or may be withdrawn before general availability.

Production Services are not automatically unreliable merely because some functionality is designated beta. Beta and preview features should be evaluated for suitability before being relied upon for critical or regulated use cases and may be subject to additional limitations communicated with the feature.

Businesses remain responsible for fallback processes if a feature is unavailable, delayed or produces an unexpected result.

13) Fees, subscriptions and credits

Some Services may be free. Others may require subscriptions, verification credits, included allowances, additional or overflow usage charges, or other fees. Current commercial pricing is shown on the pricing page, in your account, or in an order or agreement that applies to you. These Terms do not hard-code list prices.

Billing may be handled through payment providers such as Stripe. Applicable taxes may be charged where required and as shown during payment or invoicing by Checkify or its payment provider. Checkify may change pricing, plans and credit rules from time to time; changes will be reflected on the pricing page, in your account or in the order process.

Credits are service usage units used to measure successful checks or other billable activity under the applicable plan or pack. Credits are not currency, have no cash value, and cannot normally be redeemed for cash.

Credits may be subject to expiration, renewal or plan-specific rules. Unless stated otherwise for a particular plan or purchase: credits included with a subscription currently expire 30 days after they are granted; one-off credit packs do not currently expire. If a purchase, account screen or written agreement states different rules for a specific product, those specific rules apply to that product.

Where you purchase a recurring subscription, charges may continue for successive billing periods until the subscription is cancelled in accordance with the cancellation options available for your account. One-off credit packs do not automatically renew as subscriptions. Businesses can typically manage and cancel subscriptions through the business account billing tools (including the Stripe customer billing portal where enabled). Where cancellation is configured to take effect at the end of the then-current billing period, you may retain access to the applicable paid Service until that period ends. Exact cancellation timing can depend on the payment-provider and account configuration in force.

Checkify does not currently publish a separate refund policy in Stripe Checkout. Refunds, if any, are handled according to any terms shown for a specific purchase, any separate written agreement, the payment provider’s applicable process, and mandatory law (including consumer rights that cannot be excluded). These Terms do not create a general right to a refund beyond what is required by law or expressly offered for a purchase.

14) Intellectual property and licence

Checkify and its licensors retain all rights in the Services, including software, platform, APIs, SDKs, branding, documentation, designs, content and technology, except for open-source components distributed under their own licences.

Subject to these Terms, Checkify grants you a limited, non-exclusive, non-transferable right to access and use the Services for their intended purpose.

Checkify does not claim ownership of information that belongs to Users or Businesses merely because it is submitted through the Services. Checkify receives only the limited rights necessary to provide, operate, maintain and secure the Services, comply with applicable law, and otherwise process information as described in the Privacy Policy. These Terms do not grant Checkify a right to use identity documents, biometric information or verification data for unrelated AI or model-training purposes.

Except as allowed by applicable law or a separate written agreement, you must not:

• Copy, resell, sublicense or commercially redistribute the Services or proprietary Checkify materials outside permitted use.
• Reverse engineer or create derivative works from proprietary Checkify software except where the law expressly permits it.
• Remove proprietary notices from Checkify materials.
• Create misleading Checkify-branded services or use Checkify branding in a way that suggests endorsement or partnership without permission.

15) Acceptable and prohibited use

You must not use the Services to:

• Commit fraud, impersonation, abuse or other unlawful activity.
• Conduct unlawful surveillance or deceptive Verification Requests.
• Steal credentials, distribute malware, scrape, attack, overload or disrupt Checkify systems.
• Bypass security, billing, rate limits or verification controls, or manipulate verification outcomes.
• Violate third-party rights, or use Verification Results to discriminate unlawfully.
• Mislead Users about what is being requested, shared or verified.
• Knowingly alter, forge or misrepresent a Proof (including its source, assurance level, expiry or status), or replay a Proof outside its intended context where restricted.

16) Availability and service changes

Checkify may maintain, update, modify, suspend, replace, limit or discontinue features of the Services where reasonably necessary for security, legal, operational or product reasons.

We aim to keep the Services reliable, but we do not promise uninterrupted or error-free availability.

For paid Services, nothing in this section is intended to create an unrestricted right that would conflict with contractual or consumer rights that cannot lawfully be excluded. Nothing in these Terms affects rights that cannot lawfully be excluded.

17) Suspension and termination

We may suspend or terminate access to the Services, in whole or in part, where we reasonably believe there has been a breach of these Terms, fraud, a security risk, unlawful activity, non-payment, abuse, a legal or regulatory requirement, or a risk to Users, the platform or third parties.

Where practical and appropriate, we may use proportionate suspension before permanent termination. You may stop using the Services at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, liability limits that are lawful, and governing law) continue after termination.

18) Disclaimers

To the extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. Checkify does not warrant that the Services will be uninterrupted, error-free, completely secure, or suitable for every purpose.

Checkify provides verification technology. Unless explicitly contracted otherwise in writing, Checkify is not itself a law firm, regulator, compliance adviser or financial adviser.

Using Checkify does not automatically make a Business compliant with every law applying to its activities, including age-assurance or age-restricted sales laws. Checkify provides verification technology and evidence that can be used in those workflows; Businesses remain responsible for determining their legal obligations and whether their chosen Checkify configuration, enforcement and processes satisfy them.

19) Limitation of liability

To the fullest extent permitted by law, Checkify will not be liable for indirect, incidental, special, consequential or punitive losses, including loss of profits, revenue, data, goodwill or business opportunity, arising out of or relating to the Services or these Terms.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, where such exclusions are not permitted.

Separate written agreements with Business customers may set additional commercial terms, including any agreed liability arrangements. Nothing in this section limits consumer statutory rights that cannot lawfully be excluded or restricted.

20) Consumer rights

Individuals may use the Checkify app and related User Services. Nothing in these Terms limits any statutory rights that cannot lawfully be excluded or restricted.

If you are a consumer, you may have additional rights under the laws of your country of residence. These Terms should be read subject to those mandatory rights.

21) Governing law

These Terms are governed by the laws of England and Wales, except where mandatory local law gives you rights that cannot be varied by contract.

These Terms are not intended to deprive you of mandatory consumer or local protections that apply in your home jurisdiction.

22) Changes to these Terms

We may update these Terms from time to time. We will update the “Last updated” date above when we do.

For material changes, Checkify may provide additional notice where appropriate (for example by email, in-product notice or website notice).

If you continue to use the Services after updated Terms take effect, that continued use may indicate acceptance of the updated Terms where permitted by law. If you do not agree to material changes, you should stop using the Services and contact us about your account.
